According to the latest news, the case is expected to involve over 200 cross-border stores. If the defendant fails to remove infringing products within 1-2 weeks, they may face a temporary injunction (TRO) and frozen funds.

Big Cheese Bottle Insert Pry Tool
The plaintiff "My Oil Key, LLC" is an American company specializing in innovation of essential oil bottle opening tools. Its flagship product Herbs2Oils oil bottle opening key is based on the core concept of "subverting traditional bottle opening methods" and targets user pain points in essential oil care scenarios. The brand is sold through the Etsy platform and focuses on the "Big Cheese" series. Its design, resembling Swiss cheese chunks, combines functionality and fun, forming a unique identity among essential oil enthusiasts.

On April 11, 2025, My Oil Key, LLC commissioned Keener And Associates, PC Law Firm has filed a patent infringement lawsuit in the Northern Illinois court, accusing cross-border sellers of infringing on its invention patent, covering the "Bottle Insert Pry Tool" technology solution, case number 25-cv-03944. It is understood that the patented product looks like a piece of Swiss cheese from the side, and its design is a rectangular oil opener key with three circular holes in the middle of the rectangle. One end of the long side of the rectangle has a semi-circular cut, and the other end of the long side of the rectangle also has a semi-circular cut. According to US patent law, even if there are differences in product appearance, as long as the same lid opening function is achieved, it constitutes infringement and faces the risk of TRO freezing. Currently, the case is in the early stage of filing for rights protection and has not been frozen yet. Cross border sellers can quickly investigate and remove it.

JAVICED trademark is a core toy brand owned by a Chinese enterprise. On April 15, 2025, the JAVICED brand entrusted a US law firm to initiate a trademark rights lawsuit (case number: 25-cv-04027), accusing cross-border sellers of illegally using their registered trademark JAVICED in Class 28 (toys, gaming equipment) goods without authorization.
The case is currently being heard by the Northern Illinois Court in the United States. The plaintiff has not yet applied for a temporary freezing order (TRO), but based on similar cases, there may be a possibility of bulk freezing of seller account funds in the future. Therefore, it is recommended that sellers conduct a comprehensive inspection of their stores, remove all toy products containing the keyword "JAVICED" or similar designs, and avoid using expressions such as "co branded" or "officially authorized". Instead, they should use neutral descriptions such as "generic game style" or "original design" to avoid causing losses to the store due to infringement.

Its products include succulent plant shaped pillows, turtle backed bamboo patterned blankets, cactus themed coasters, etc. Through geometric plant elements and low saturation color matching, it creates a "touchable natural space".
